Bill by House of Representatives to Ban Participants of Oct. 7 Attacks from Entering US

The House of Representatives has unanimously approved legislation that would prevent anyone involved in the October 7 Hamas attacks on Israel from immigrating to the United States. The measure, titled the No Immigrants Benefits for Hamas Terrorists Act of 2025, was introduced by Representative Tom McClintock and has been highlighted as a rare instance of bipartisan agreement on an Israel-related vote.
The law aims to amend the Immigration and Nationality Act, targeting foreign nationals who participated in, planned, financed, supported, or facilitated the attacks. McClintock compared those responsible for the assaults to Nazi collaborators during the Holocaust, who are similarly restricted under U.S. immigration law.
McClintock also referenced Mahmoud Amin Yaqub al-Muhtadi, a Gaza-born resident of Lafayette who entered the U.S. in 2024 and was arrested in October for his alleged role in the October 7 attacks.
Once enacted, the legislation would require the Secretary of Homeland Security to submit an annual report to Congress detailing the number of foreign nationals denied entry due to involvement with Hamas terrorism, starting within one year of the laws passage.
In addition, the bill officially designates Hamas and the Palestinian Islamic Jihad as terror organizations whose members and supporters are prohibited from entering the United States under the Immigration and Nationality Act.
While Democratic lawmakers expressed support for the goal of the legislation, they questioned the approach of amending immigration law to reference a specific attack. Representative Jamie Raskin noted that, in contrast, following the 9/11 attacks, the U.S. overhauled immigration policies and created the Department of Homeland Security without naming the September 11 events in the law.
The bill now moves to the Senate for consideration.
