Maurene Comey, a federal prosecutor known for leading high-profile cases involving Jeffrey Epstein and Ghislaine Maxwell, appeared in a Manhattan federal courtroom on Thursday. Her lawsuit alleges that she was dismissed as a political reprisal connected to her father, former FBI director James Comey.
According to the suit, she was removed from her position in July, shortly after overseeing the federal prosecution of Sean Diddy Combs, who was convicted on prostitution-related charges. The filing states that the Justice Department under Donald Trump dismissed her without justification, citing only article 2 of the United States constitution and the laws of the United States in a brief email.
Comey claims she requested an explanation from U.S. attorney Jay Clayton, who allegedly responded that the order came from Washington and that he could say nothing further. The lawsuit also notes that just three months before her dismissal, she received an exceptional performance review from the same official who later notified her of the termination.
The complaint argues that the government offered no valid reason for removing her, asserting instead that she was targeted either because of her relationship to the former FBI director or due to her perceived political views.
Thursdays session was largely procedural and lasted under an hour. Comeys attorneys pushed to move forward with the discovery phase, during which evidence is exchanged. Meanwhile, government lawyers argued that an employment arbitration board, where Comey has also filed a complaint, should address the allegations before the federal court proceeds. The judge indicated he may delay discovery until determining which venue should handle the case.
Comeys legal team maintained that evidence should be disclosed immediately, emphasizing that the same documents would be required in both proceedings. One of her attorneys, Nicole Gueron, stated that the lack of explanation for an immediate termination suggests wrongdoing where none existed, and proposed that the government at least release initial documentation identifying who made the decision and why.
Beyond reinstatement and back pay, Comey seeks a court ruling declaring that her dismissal violated constitutional protections and the separation of powers. The lawsuit names the Department of Justice and former Attorney General Pam Bondi among the defendants.
James Comey served as FBI director from 2013 until his removal by Trump in 2017. The former president publicly criticized him repeatedly across social media, and both Comey and others previously pursued by the administration have argued that they were targeted for political reasons. A federal judge later dismissed criminal charges against the elder Comey, ruling that the prosecutor who brought the case lacked lawful authority.
Following that outcome, James Comey stated that the ruling signaled a critical message: no president should use the Justice Department as a tool against political opponents. He affirmed his innocence and said he was unafraid of any future attempts to pursue him.
